Woman in Her 30s Jailed for False Rape Claim; Legal Repercussions Increased

A woman falsely accused her father of rape after he refused to give her money. She has been sentenced to prison.

The Namyangju Branch of Uijeongbu District Court's Criminal Division 1, led by Judge Choi Chi-bong, sentenced a woman, identified as A, to 10 months in prison for defamation, obstruction of business, and insult.

A posted 11 defamatory messages online in May and June last year, titled "I am a victim of familial sexual violence," targeting her father, B.

Her posts falsely claimed, "My biological father has assaulted me since age four," "My mother also suffered domestic and sexual violence," "30 million won in damages settled the matter," and called for "severe punishment."

A revealed B's name and business details, causing him business difficulties.


 


She also accused B of remarrying a woman, C, alleging an affair through six posts.

In February 2021, A sued B for damages regarding sexual assault at Incheon District Court but couldn't prove illegal acts.

During trial, A claimed her posts were true, but the court rejected this, noting the lack of evidence for habitual assault by B.

The court found A's accusations false, highlighting B's financial support during her studies and the timing of the rape accusation after he refused money for a cafe venture.


The court stated, "False information was posted out of dissatisfaction with financial denial. Victims' reputations are irreparably damaged."


The court cited high reoffending risk and victims' desire for severe punishment as sentencing reasons, noting A's continued similar writings.
